CALL TO ORDER

The meeting was called to order at 7:00 p.m. by Mayor Orchard.

APPROVAL OF MINUTES AND NOTICE OF WAIVING READING

1. Regular meeting of November 13, 2002

-- Notice of waiving the reading of all ordinances introduced and/or adopted under this agenda.

It was moved by Kurvers, seconded by Fox, to approve the minutes of November 13, 2002 and to waive the reading of all ordinances introduced and/or adopted under this agenda.

ORAL AND WRITTEN COMMUNICATIONS

Announcements

-- The Holiday Tree Lighting event will take place on Wednesday, December 4, 2002 at 6:00 p.m. in La Plaza Park. Following caroling in the park, festivities will continue at the Fire Station where Santa will make an appearance. Punch, cookies and holiday crafts for the kids will be available.

-- The City Council will be hearing a presentation on Articles 2 and 3 of the Land Use Code at 7:00 p.m. on Thursday, December 5, 2002. Articles 2 and 3 are concerned with allowable land uses and standards for public and private development. The public is invited to attend the study session.

-- An Events Summit will be held December 7, 2002, 9:00 a.m. to 12:00 noon, Multi-Purpose Room.

The Mayor called attention to the announcements.

Correspondence and Presentations

3. Presentation of Cotati Chamber of Commerce Quarterly Report for the Period Ending September 30, 2002.

At the request of the Chamber of Commerce, this item was pulled from the agenda, to be placed on the agenda for the regular meeting of December 11, 2002.

CITIZEN BUSINESS

George Barich, 176 W. Cotati Oaks Court, said he is deeply concerned regarding the conduct of Councilmember Harold Berkemeier during the election. He said he feels Mr. Berkemeier owes the two female candidates an apology. He went on to ask if provisions have been made for communications between the new police facility and City Hall; he asked staff and Council to look into that. On another subject, he said that Cingular Wireless is trying to place a cell site at the Cotati fire station and is running into difficulties with the Fire District Board. He asked City staff and Council to facilitate some sort of agreement to benefit all involved.

City Manager Shaddox indicated he will respond to Council and to Mr. Barich regarding the communications conduit between the new police facility and City Hall.

PUBLIC HEARINGS

4. Introduction of Ordinance No. 742 Adding Section 13.36.040 – Connection Required; Exceptions to Chapter 13.36 "Sewers Required" Provisions of the Cotati Municipal Code. (City Engineer)

It was moved by Kurvers, seconded by Fox, to remove this item from the agenda, to be placed on the agenda for the regular meeting of December 11, 2002.

CONSENT CALENDAR

Mayor Orchard read the title of the Consent Calendar item and asked if anyone wished to comment on it. There was no public comment.

5. Approve Participation in the "Rebuilding Together Cotati/Rohnert Park" Program and Authorize Expenditure of $25,000 from the Inclusionary Housing Fund.

It was moved by Fox, seconded by Kurvers, to approve participation in the "Rebuilding Together Cotati/Rohnert Park" program and authorize expenditure of $25,000 from the Inclusionary Housing Fund for that purpose.

REGULAR AGENDA

6. Approval of Winter 2002 and Spring 2003 Recreation Program/Status of Recreation Programs to Date. (Recreation Coordinator)

Assistant City Manager Dorch reviewed the status of the recreation program as well as the proposed Winter and Spring Program. He noted that the proposed program will go before the Community and Environment Commission at its next regular meeting.

Recreation Coordinator Dutra was commended by Council for the variety and interest range of the classes.

There was no public comment.

Council consensus was to receive and file the Winter 2002 and Spring 2003 Recreation Program.

7. Cotati Endorsements for Appointments to SMART II Commission. (City Manager)

City Manager Shaddox reported briefly on the pending appointments to the SMART II Commission and recommended Council provide recommendations to the Mayor who will vote on the appointment at the December 12, 2002 City Selection Committee meeting.

There was no public comment.

Council discussion ensued, and a ranking of preferred candidates was developed for appointment to the SMART II Commission.

8. Appointment of a City Council Member to a County-wide Committee to Evaluate a Proposed County-wide Housing Impact Fee on Commercial and Industrial Projects. (Assistant City Manager)

Assistant City Manager Dorch gave a staff report and responded to questions from Council.

Mayor Orchard offered to take the appointment, having attended one meeting already and being willing to continue.

JOINT MEETING OF CITY COUNCIL AND REDEVELOPMENT AGENCY BOARD OF DIRECTORS

The joint meeting was called to order at 7:37 p.m. by Mayor/Chair Orchard.

10. Approval of Warrants and Audited Claims for the Period November 7th - November 20th, 2002. (Finance Director)

It was moved by Kurvers, seconded by Fox, to approve the Consent Calendar.

Adjournment of joint meeting; reconvening of regular meeting of City Council

The joint meeting was adjourned, and the regular City Council meeting reconvened, at 7:38 p.m.
